Consent and Liability Waiver

AGREEMENT OF RELEASE AND WAIVER OF LIABILITY
By checking the box below, I intend to be legally bound by the following:

I warrant and represent that I am in good physical health and do not suffer from any medical condition which would limit my participation in the yoga classes, workshops, or other activities offered at Yogamotif, LLC. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any of the classes, workshops, or other activities offered by Yogamotif, LLC. I understand that yoga is not a substitute for medical attention, examination, diagnosis or treatment. I represent and warrant that I understand the potential risks and hazards associated with the physical activities offered by Yogamotif, LLC and I agree to follow all instructions so that I may safely participate in classes, workshops, or other activities. If I experience any pain or discomfort, I will listen to my body, adjust the posture, ask for support from the teacher, and/or discontinue all activity.

I hereby WAIVE AND RELEASE Yogamotif, LLC, and its owners, officers, employees, contractors, and instructors from any claim, demand, or cause of action of any kind resulting from or related to my participation in the programs offered by Yogamotif, LLC or at Yogamotif, LLC’s studio. In taking part in the yoga classes, workshops, or other activities offered by Yogamotif, LLC I understand and acknowledge that I am fully responsible and liable for all risks, injuries, or damages, known or unknown, which might occur as a result of my participation in the classes, workshops, or other activities.

Furthermore, I accept liability and responsibility for any injury that I may cause either to myself or to any other participant and/or instructor while in attendance at an activity or class offered by Yogamotif, LLC or at Yogamotif, LLC’s studio. I agree to INDEMNIFY AND HOLD HARMLESS Yogamotif, LLC, and its owners, officers, employees, contractors, and instructors from liability for the injury or death of any person(s) and damage to property that may result from my actions while participating in activities offered by Yogamotif, LLC.

I have read the above release and waiver of liability and fully understand its content. I am legally competent to sign and voluntarily agree to the terms and conditions stated above. This agreement is governed by the laws of the State of Pennsylvania.

Viewer understands that any and all content, curriculum, methods, images, and motion pictures used in the video above are protected by copyright and other intellectual property laws and therefore is exclusively owned by Yogamotif LLC. By utilizing and/or viewing this video you agree that you will not extract, record, photograph, distribute, redistribute, offer for sale, modify, share, extrapolate from, or otherwise use any of the content in the video, or any images or stills thereof, without express written consent of Yogamotif, LLC. This class may only be used by participants for its intended personal use.

AGREEMENT OF PHOTO RELEASE
I hereby grant Yogamotif, LLC the right and permission, in perpetuity, to copyright and/or publish, reproduce, modify, distribute, or otherwise utilize any photographs or videos of, or about me taken while attending a Yogamotif, LLC activity, class, and/or event in or on its website, advertisements, brochures, or in any other official publications of Yogamotif, LLC, for purposes of promoting, publicizing, advertising, showcasing, and/or displaying the activities of Yogamotif, LLC or any other lawful purpose, without further considerations or consent required. I also acknowledge that Yogamotif, LLC may choose not to use a photograph, video, or this information at the present time, but may do so at a later date. For purposes of clarity, I expressly waive any and all legal and moral rights I may have in connection with my appearance for the purposes described above.

I hereby release, hold harmless, and forever discharge Yogamotif, LLC and its owners, officers, employees, contractors, and instructors from any and all claims, demands or causes of action that I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate may now have or may hereafter have by reason of this authorization, including but not limited to libel, defamation, violation of my rights of privacy, publicity, infringement of copyright or trademark or any other right arising out of or relating to any utilization of the rights granted herein or based upon any failure or omission to make use thereof. I also waive any right to royalties or other compensation arising or related to the use of my appearance.
 
I hereby waive any right of inspection or approval of my appearance or the uses to which such appearance may be put. I also understand that once a photograph, video, or name is posted on the Yogamotif, LLC Website, the photograph(s) or video(s) can be downloaded by any computer with Internet access.

By utilizing and/or viewing video and live workshop you agree that you will not extract, record, photograph, distribute, redistribute, offer for sale, modify, share, extrapolate from, or otherwise use any of the content in the video, or any images or stills thereof, without express written consent of Yogamotif, LLC. Yogamotif, LLC classes may only be used by participants for its intended personal use.
